"We suspect a trademarked and therefore unlawful use of the term Bold in connection with a Focus Bikes product family designated as such. Of course, only a court can conclusively clarify whether this is the case. Accordingly, we have initiated such proceedings after Derby Cycles refused to refrain from using the sign after repeated requests. We fear a risk of confusion and a dilution of our brand image in the medium term," says Vincenz Droux, owner of the start-up Bold Cycles.

Bold Cycles has already had to enforce its trademark rights against third parties in several cases - in the USA, England and the Netherlands - and has been able to obtain a waiver of unlawful use in all cases to date. From Focus's point of view, the handling of naming rights should be well known, as its own history proves, the Lengnau-based bike manufacturer adds.
